General conditions of sale
Article 1 - Purpose
These conditions govern the relationship between, on the one hand, the Company AURAGE Société par Actions Simplifiée (SAS) with capital of 18,000 euros, registered in the PARIS Trade and Companies Register under number Paris B 952 705 622, whose registered office is located at 40 Rue des Blancs Manteaux 75004 Paris, hereinafter referred to as “the Company” or “the seller”, and on the other hand, the Internet user wishing to place an order, hereinafter referred to as “the Customer”.
These General Conditions of Sale apply without restriction or reservation to all sales concluded by "the Company" with regard to products sold in the electronic catalog of the website aurage.co within the framework of a distance selling system.
Article 2 - Products
We draw the Customer's attention to the fact that the photographs illustrating our products may appear slightly different from reality due to the settings of the Customer's screen and the lighting during the shooting.
Furthermore, as these are handcrafted creations, the items may have irregularities in finish, differences in size and/or shades of stones inherent to this type of manufacturing, which cannot be considered as defects. The Company cannot be held liable, and the validity of the order cannot be affected.
The photographs, graphics and descriptions of the products offered for sale are for informational purposes only and do not bind the Company in any way. Customers can obtain additional information by contacting Customer Service by email at laura@aurage.co
Article 3 - Payment and pricing
3.1 Payment:
The Customer can pay for their purchases by credit card, PayPal, or bank transfer. Accepted payment cards are: CB, MasterCard®, Visa®, and American Express®.
In the event of payment by PAYPAL, the Customer expressly acknowledges having read and accepted the general conditions of PAYPAL, which is solely responsible for processing personal data relating to the means of payment entered by the Customer.
When paying, the bank requests personal information from the Internet user in order to verify the identity of the cardholder and validate the transaction. The Customer must provide their bank card number, depending on the type of card, its expiry date and the cryptogram number (3-digit number on the back of the bank card).
The Customer guarantees to the Company, when validating his order form, that he is in good standing with the issuer of the payment card.
Financial information will be transferred using an encrypted protocol to PAYPAL or other banks providing services related to remote electronic payment, without third parties being able to access it under any circumstances.
3.2 Pricing:
The prices displayed on the Aurage.co website are expressed in euros.
Prices in euros are clearly indicated and include all applicable taxes, except for shipping costs which are the responsibility of the Customer.
Deliveries depending on the destination:
-DOM TOM: Customs taxes and formalities are the responsibility of the customer.
-European Union: Customs taxes and formalities are the responsibility of the Company.
-United Kingdom: As the United Kingdom is no longer part of the European Union, customs taxes and formalities are the responsibility of the customer.
-For deliveries to the United States, the prices indicated include all applicable taxes, with the exception of shipping costs which remain the responsibility of the Customer.
-For deliveries to a country using the USD currency, but outside the United States, customs taxes and formalities are the sole responsibility of the Customer, unless otherwise indicated.
The Customer is responsible for checking the import possibilities of the products ordered, taking into account the regulations in force in the country of delivery.
Delivery is made using the DDU (Delivery Duty Unpaid) system.
The recipient is responsible for paying all import or local taxes related to their order.
In the event of an exchange or refund, customs taxes and formalities are entirely the sole responsibility of the customer.
Article 4 - Delivery costs
The Site delivers throughout the European Union and the rest of the world. The ordered product is delivered to the address shown on the Customer's order form. The delivery address may differ from the billing address.
The delivery time depends on the delivery address and the delivery method selected by the Customer. Any delays related to customs clearance of the exported goods shall not be the responsibility of the Company.
The Company will deliver the Jewelry(s) to the address indicated when ordering, via a carrier designated by the Company, within the time period mentioned when ordering and in any event within a maximum period of 30 (thirty) days for Jewelry mentioned as being in stock on the Site. This period may be extended pending restocking.
In this regard, in the case of an order that includes several items with different delivery times, the Company waits for the availability of all the items before proceeding with the shipment. You will be informed of the dispatch of your order by email.
Failure or delay in delivery. In accordance with Articles L216-2 and L216-3 of the Consumer Code, in the event of a delay or failure to deliver seven (7) days after the maximum delivery date indicated, which is not attributable to an error on your part, nor to the unforeseeable and insurmountable act of a third party, nor to a case of force majeure, you may cancel your order by registered letter with acknowledgment of receipt addressed to the Company during the sixty (60) days following the maximum delivery date indicated. If delivery has not taken place between the sending and receipt of this letter, the Company will reimburse you the full price that you have actually paid for each undelivered Jewel, within a maximum period of fourteen (14) days.
Delivery costs are free for orders of €90 or more.
In the event of damage, the Customer shall express their reservations precisely and clearly on the delivery slip, a copy of which shall be sent by La Poste or the carrier to the Company. In this respect, it is the Customer's responsibility to check the content, conformity and condition of the product upon delivery. This check shall be deemed to have been carried out once the Customer, or a person duly authorized by them, has signed the delivery slip presented by the La Poste recipient or the carrier.
Despite the care taken in preparing orders, it is possible that a product may be missing from your order, or that an error may have occurred during preparation. If you notice such an error, please report it to us by email at laura@aurage.co within a maximum of 48 hours of receiving the order.
Article 5 - Right of withdrawal
In accordance with Article L.221-18 of the Consumer Code, the Customer has a right of withdrawal which he can exercise without having to justify reasons, within a period of fourteen (14) calendar days from receipt of the order.
To exercise his right of withdrawal, the customer must inform the Company of his decision to withdraw by sending a clear declaration by e-mail to laura@aurage.co or by post to the following address: 40, rue des blancs manteaus 75004 Paris.
In the event of exercising the right of withdrawal within the aforementioned period, the Company undertakes to fully reimburse the customer for all sums paid, including standard delivery costs, as soon as possible and no later than fourteen (14) days from receipt of the withdrawal request.
However, the cost of returning the jewelry remains the responsibility of the customer, unless the return is due to an error by the Company or a lack of conformity of the product.
The Customer is required to return the jewelry in perfect condition, in its original packaging, accompanied by all accessories, instructions for use and other documents provided. The Company reserves the right to refuse reimbursement if the returned jewelry is damaged, worn, incomplete or shows signs of excessive use.
In the event of partial withdrawal of the order, the refund will only apply to the products concerned by the withdrawal.
The right of withdrawal does not apply to personalized or custom-made products, as well as to sealed products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.
If the Customer has benefited from a promotional offer including a gift or a particular benefit, the withdrawal will also result in the cancellation of this benefit, and the Customer must return the gift or benefit at the same time as the jewelry.
The Company undertakes to make the reimbursement using the same means of payment as that used by the Customer for the initial transaction, unless the Customer expressly agrees to a different means of reimbursement, which will not incur any additional costs for the latter.

Article 6 - Return and exchange procedure
For any return or exchange of jewelry, please follow the procedure detailed below:

Indicate the reason for the return or exchange:
When contacting our customer service team, please clearly state the reason for your return or exchange. Whether it's an incorrect size, a manufacturing defect, or simply because you've changed your mind, we're here to help.
Return and exchange conditions:
a. Deadline: Returns or exchanges must be made within fourteen (14) calendar days of receipt of your order.
b. Product Condition: Returned or exchanged jewelry must be in perfect condition, unworn, and in its original packaging. Any returned jewelry showing signs of use, deterioration, or not meeting these conditions will not be accepted for a refund or exchange.
c. Personalized Jewelry: Personalized jewelry is not refundable or exchangeable, except in the event of a manufacturing defect.
Return terms:
a. Secure Packaging: Before returning jewelry, make sure to carefully pack it in its original box or suitable packaging to avoid damage during transportation.
b. Return costs: Return costs remain the responsibility of the Customer, except in the event of an error on our part or a lack of conformity of the product.
c. Return Address: To make your return, please ship the jewelry to the address indicated on the order form.
Exchange procedure:
a. Size Exchange: If you would like to exchange a piece of jewelry for a different size, please inform our customer service team when you contact us. We will inform you of the availability of the desired size and the steps to follow for the exchange.
b. Model exchange: For a model exchange, please first make a return in accordance with the procedure described above, then place a new order online for the desired jewelry.
Refund :
a. Timeframe: Once we have received and verified the returned jewelry, we will process the refund within fourteen (14) days of receiving your return request.
b. Method of reimbursement: The reimbursement will be made using the same means of payment as that used for the initial transaction, unless you expressly express another choice, which will not incur any additional costs for you.

Article 7 - Guarantees
The Company undertakes to offer a commercial guarantee of a duration of 6 months from the delivery date for all purchases made by the Customer. This guarantee aims to ensure the conformity and quality of the products sold by the Company.
Warranty Conditions
To benefit from the 6-month warranty, the Customer must respect the following conditions:
a. Intended Use: The products must be used in accordance with their normal use and the recommendations provided by the Company. Any improper, negligent use or use not in accordance with the maintenance instructions will result in the cancellation of the warranty.
b. Retention of proof of purchase: The Customer must retain the invoice or receipt of purchase as proof of purchase in order to benefit from the warranty. Without this proof, the Company will not be able to honor the warranty.
c. Notification of defects: In the event of a defect being found in the product, the Customer must inform the Company as soon as possible and at the latest before the expiry of the 6-month warranty period. The Customer must provide a detailed description of the defect found.
Scope of the warranty
The 6-month warranty covers manufacturing defects, hidden defects and non-conformities of the products compared to their description on the Site at the time of purchase.
Warranty Exclusions
The 6-month warranty does not cover the following cases:
a. Normal Wear and Tear: Products may show signs of normal wear and tear over time, which is not covered by the warranty.
b. Accidental Damage: Damage caused by accidents, shocks, falls, or any other abnormal or negligent use is not covered by the warranty.
c. Unauthorized Modification or Repair: Any modification or repair carried out by anyone other than the Company or an authorized service provider will void the warranty.
d. Personalized jewelry: Personalized products, made to measure according to the specific requests of the Customer, are not covered by the warranty, except in the event of a manufacturing defect.
Procedure for implementing the guarantee
If a product is covered by the warranty and develops a defect during the warranty period, the Company undertakes to repair the product or replace it with a similar product depending on availability. If a repair or replacement is not possible, the Company will refund the product.
Contact for warranty
To claim the 6-month warranty, the Customer must contact customer service by email at: laura@aurage.co , providing the necessary information regarding the purchase and the defect found. Customer service will inform the Customer of the procedure to follow for processing the warranty.
Limitation of liability
The Company shall not be held liable under any circumstances for indirect, consequential or accidental damages resulting from the use of the products, even in the event of a defect covered by the warranty.
Modification of the T&Cs
The Company reserves the right to modify these warranty conditions at any time. Any modification will be brought to the attention of the Customer on the Site and will be applicable from the time it is posted online.
Article 8 - Protection of personal data
Delivery of the order requires the provision of a certain amount of personal information concerning the Customer, namely in particular his/her surname, first name, postal address, date of birth, telephone number, email address. The data collected is necessary for the Company to comply with its obligations, in particular for the validation of the order, as well as for the execution of the delivery. The Customer who does not wish to provide this information will not be able to order on the Site.
This data is kept for this sole purpose and the Company undertakes not to use it for any other purpose, nor to transmit it to third parties, without the express consent of the Client or outside of the cases provided for by law. The data controller, except for payment data, is the Company, whose contact details are indicated above. This information is kept for the legally authorized limit. This duration varies depending on the nature and circumstances in which it was communicated to us.
This data is stored in secure conditions, using current technical means, in compliance with the provisions of Law No. 78-17 of January 6, 1978. The Company's CNIL declaration number is 1995781.
The transmission of information on the Site takes place in a secure context using the protocols in force on the Internet.
Payment card numbers are not stored on the Site but on the secure site of our banking establishment.
In accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify, and object to your personal data. Article 9 - Responsibilities
The Company is committed to providing quality jewelry, carefully designed and manufactured to exacting standards. However, despite our best efforts to provide you with impeccable products, it is important to understand and accept the seller's liability limitations for any damages related to the use of the jewelry.
Proper Use of Jewelry: Jewelry sold by the Company is intended for personal use. It is essential to wear and care for it according to the instructions provided, in order to prevent any risk of potential damage.
Risks inherent in the use of jewelry: As with any jewelry, there are inherent risks associated with its use, such as the risk of scratches, natural wear and tear, damage caused by shocks or impacts. The Company declines all responsibility for these damages which may result from normal use or an accident.
Allergic reactions: Although our jewelry is designed with quality materials and carefully selected to minimize the risk of allergies, it is possible that some people may experience allergic reactions. It is the customer's responsibility to ensure that they are not allergic to the materials used before purchasing our jewelry. The Company cannot be held responsible for any allergic reactions.
Loss or theft: The Company is not responsible for jewelry lost, stolen, or damaged after delivery to the Customer. It is the Customer's responsibility to take the necessary steps to ensure the safety and preservation of their jewelry.
Personalized Jewelry: With regard to personalized jewelry, the Company cannot be held responsible for customization errors if the information provided by the customer is incorrect or incomplete.
Limitation of Liability: To the fullest extent permitted by law, the Company, including its officers, employees, affiliates, contractors and suppliers, shall not be liable to the Customer or any third party for any direct, indirect, consequential, special or incidental damages, including but not limited to damages for loss of profits, data, business opportunities or any other financial loss, arising from the use of jewelry sold on our site.
Force Majeure: The Company shall not be liable for delays or failures in the performance of its obligations under these T&Cs if such delays or failures are due to circumstances beyond its control, such as natural disasters, armed conflicts, strikes, technical failures, or any other force majeure situation.
Indemnification: The Customer agrees to indemnify and hold harmless the Company, as well as its officers, employees, affiliates, subcontractors and suppliers, from any liability, demand, claim or damage, including reasonable attorneys' fees, resulting from the use of the jewelry, in violation of these T&Cs, or any other violation of third-party rights.
The provisions of this Liability Section shall survive the expiration or termination of these Terms and Conditions.
Article 10 - Applicable law / Disputes
The law applicable to this contract is French law. In the event of a dispute relating to the formation, execution, and/or interpretation of the General Terms and Conditions, express jurisdiction is granted to the French courts.
Article 11 - Intellectual property
The Jewelry, the Site, the services offered, as well as all content, texts, databases, software, visual and audiovisual elements that compose it are the exclusive property of the Company, and are protected by intellectual property law. Any act of exploitation of the aforementioned elements, in particular by reproduction and/or representation, is expressly prohibited.
The “AURAGE” trademark is a registered trademark . No license or authorization for reproduction is granted for the aforementioned trademark or for any other trademark used by the Company or its co-contractors.
